Durable Power of Attorney
A Power of Attorney (POA) document is used to transfer your legal decsion making ability to another person or persons. This power may be transferred to another:
- immediately, as in a General Power of Attorney
- Upon my disability
Such Power of Attorney can be specific to certain legal matters, as in the sale of property, or for directing medical care of children or the Power may be general, covering all sorts of legal issues.
In the context of your healthcare, a Durable Power of Attorney is used to give another, trusted person the authority to order and dictate medical care for you in the even of your incapacitation. This can be very important and can prevent you from languishing in the medical system awaiting care while treatment authority is sought.
In the case of your total incapacitaty, the Power of Attorney gives your trusted person the authority to order or to discontinue care according to their judgement.
A POA document is effective until your death or until you revoke it and should be constructed in concert with a Living Will and/or Living Trust.
