Legal Issues in Your Retirement

Moving into retirement creates legal issues in the lives of most retirees. Also, as we age, we are faced with new health and financial issues. It is quite important that we make certain that our legal documents continue to properly reflect the current state of our lives. As events and circumstances in you life change, you need to synchronize your legal documents to reflect those changes.

First of all, we must keep our Last Will and Testament up to date and reflective of our current desires and needs.

A Durable Power of Attorney is the instrument used to delegate your decision authority under certain conditions that you define.

Your Living Will is the document that you use to make your desires known as to medical treatment that you desire in the event of an accident or a severe medical condition.

These documents can be very simple or very complex, dependent on your condition, financial structure, and desires. There are 'boilerplate' Forms available at bookstores, office supply merchants or on the internet that can legally be used for simple matters and they are certainly better than having no documents in place at all.

It is relatively inexpensive to hire the professional legal resources to prepare these documents for you and this is really important in the case of pending serious illness, large amounts of financial resources, and tax consequences. Usually, the few dollars spent periodically to consult an attorney on these matters is a very good investment.

Since the forms are so inexpensive, some people buy and fill out the various forms and then take them to an attorney for review and improvement. That does 2 things:

1. It forces you to think through the various issues and your desires privately and without any pressure, and

2. It will same the attorney's time in making sure that your desires and needs are adequately addressed in the final documents. Of course, saving the attorney time should save you money, too.
